Terms and Conditions

1. Promoter

The promoter is Allsports Distribution Limited, the New Zealand distributor of Marmot (the Promoter).

2. Competition period

The Marmot Outside Photo Competition opens on 11 September 2026 and closes at 11:59pm NZDT on 11 October 2026 (Competition Period). Entries received after the closing time will not be accepted.

3. Eligibility

Entry is open to New Zealand residents aged 18 years or over. Employees of the Promoter and their immediate families are not eligible to enter. No purchase is necessary.

4. How to enter

To enter, participants must email marketing@allsports.co.nz during the Competition Period with:

·    Up to three original photographs showing Marmot gear in action

·    Their full name

·    The location where each photograph was taken

·    The Marmot product featured, if known

·    A short caption or story about the image

·    Their Instagram handle, if they would like to be tagged

·    The confirmation specified in clause 7

Entries must be no larger than 20MB per email. If the files exceed this limit, entrants may include a link to download the images. Phone and camera photographs are both welcome, and entrants should submit the highest-quality version available.

Each person may enter a maximum of three photographs. Multiple emails do not increase this limit. Incomplete entries, or entries that the Promoter cannot access or download, may be deemed invalid.

5. Photograph requirements

Each photograph must:

·    Show Marmot gear that is visible and being used

·    Have been taken by the entrant

·    Be owned by the entrant and not subject to an exclusive licence or agreement that prevents its use under these terms

·    Be suitable for public display

·    Not contain unlawful, offensive or inappropriate material

·    Not depict unsafe, illegal or environmentally irresponsible activity

·    Not be generated using artificial intelligence

Photographs may have been previously published or entered in another competition, provided the entrant continues to own the necessary rights and can grant the permissions set out in these terms.

6. Entrant confirmation

By submitting an entry, each entrant confirms that they took and own the submitted photographs; have permission from every identifiable person appearing in them, including parent or legal guardian permission for anyone under 18; and have read and agree to these Terms and Conditions. The Promoter may request evidence of ownership or permission at any time.

7. Shortlisting and judging

Following the close of the Competition Period, up to ten entries will be selected as finalists. The finalists may be published on Marmot New Zealand’s social media and other organic marketing channels. Being published does not mean an entrant has won the competition.

The winner will be selected by Aimee Jules on behalf of Marmot New Zealand based on:

·    Creativity and originality

·    Composition and visual impact

·    How well the image captures adventure and Marmot gear in action

·    The accompanying caption or story

This is a judged competition, and the winner will not be selected randomly or based on social-media likes. The judges’ decision is final, and no correspondence will be entered into.

8. Prize

The winner will receive their choice of available Marmot products up to a total standard recommended retail price of NZ$2,000.

The winner may select full-price or discounted products. All products will count toward the NZ$2,000 prize limit at their standard recommended retail price, regardless of any advertised sale or promotional price.

Product selection is subject to availability, including available colours and sizes, and must be completed as one order. If the selected products total less than NZ$2,000 RRP, the unused balance will be forfeited and will not be provided as cash, credit or a voucher. If the selected products exceed NZ$2,000 RRP, the winner may pay the difference with the Promoter’s agreement.

The prize is not transferable, refundable or redeemable for cash. Standard delivery to one New Zealand address is included.

9. Winner notification

The winner will be contacted using the email address supplied with their entry by 16 October 2026. The winner must respond within seven days of being contacted. If the winner cannot be contacted, does not respond within that period, is found to be ineligible or cannot accept the prize, the Promoter may select another winner.

The winner’s name and winning photograph may be announced through Marmot New Zealand’s social-media, website and email channels.

10. Ownership and use of photographs

Entrants retain copyright in their photographs.

By entering, each entrant grants Allsports Distribution Limited and Marmot New Zealand a non-exclusive, royalty-free licence to reproduce, publish, resize, crop and share their submitted photographs for:

·    Administering and promoting this competition

·    Announcing and showcasing finalists and the winner

·    Future organic Marmot New Zealand social-media content

·    Marmot New Zealand website content

·    Marmot New Zealand email marketing

The Promoter will provide photographer credit where reasonably practical. This permission does not include paid advertising, sale to third parties or licensing the photograph for use by unrelated third parties. The Promoter will contact the photographer separately if it wishes to negotiate any additional commercial use.

Entrants acknowledge that publication is not guaranteed and that publication of an entry does not indicate that it has been shortlisted or selected as the winner.

11. Privacy

Personal information collected through the competition will be used to administer the competition, contact entrants, select and announce the winner, and arrange the prize.

Entry email addresses will not be added to marketing databases solely because a person entered the competition, unless the entrant separately agrees to receive marketing communications. Personal information will be handled in accordance with applicable New Zealand privacy law.

12. General

The Promoter reserves the right to verify entries and entrant eligibility, request original image files or evidence of permissions, and disqualify any entry that breaches these Terms and Conditions.

The Promoter may cancel, suspend or amend the competition if circumstances outside its reasonable control prevent it from being conducted as intended. Any changes will be communicated through Marmot New Zealand’s social-media channels.

To the extent permitted by law, the Promoter is not responsible for entries that are lost, delayed, corrupted, inaccessible or not received due to technical issues.

This promotion is not sponsored, endorsed, administered by or associated with Facebook or Instagram. Entrants release Facebook and Instagram from any responsibility in connection with the promotion.
